These Terms govern your access to OpenCivy and the founder workflow tools made available by BluShark Inc., a company organized in Wyoming, USA.
1. Agreement to these Terms
These Terms of Use govern your access to and use of OpenCivy, including the website, founder workspace, and related services operated by BluShark Inc., a Wyoming, USA company. By accessing or using OpenCivy, you agree to be bound by these Terms. If you do not agree, do not use the service.
2. Eligibility and account responsibility
You must provide accurate account information and keep your login credentials secure. You are responsible for activity that occurs under your account and for ensuring that your use of OpenCivy complies with applicable law.
3. What OpenCivy provides
OpenCivy helps founders structure venture ideas, validate markets, define MVP scope, and generate startup planning materials. OpenCivy is a software workflow product. It does not provide legal, tax, accounting, fundraising, or investment advice.
4. Acceptable use
You may not use OpenCivy to violate law, infringe intellectual property rights, upload harmful code, interfere with platform security, attempt unauthorized access, or submit content that is fraudulent, abusive, or misleading.
5. Your content
You retain ownership of the information, prompts, documents, and other content you submit to OpenCivy. You grant BluShark Inc. the limited rights needed to host, process, transmit, and display that content solely to operate, secure, and improve the service for you.
6. Intellectual property
OpenCivy, including its software, workflows, branding, visual design, and related materials, is owned by or licensed to BluShark Inc. Except for the limited right to use the service under these Terms, no license or ownership right is transferred to you.
7. Third-party services
OpenCivy may rely on third-party infrastructure and AI providers to operate features such as authentication, storage, model processing, analytics, and research enrichment. Your use of integrated third-party features may also be subject to those providers’ terms and policies.
8. Service changes and availability
We may modify, suspend, or discontinue features at any time. We aim to keep OpenCivy available and secure, but we do not guarantee uninterrupted or error-free operation.
9. Disclaimers
OpenCivy is provided on an “as is” and “as available” basis to the fullest extent permitted by law. BluShark Inc. disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the fullest extent permitted by law, BluShark Inc. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities arising from or related to your use of OpenCivy.
11. Termination
We may suspend or terminate access if we reasonably believe you violated these Terms, created risk for the platform, or used OpenCivy unlawfully. You may stop using the service at any time.
12. Governing law
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the use of OpenCivy will be resolved in the appropriate courts located in Wyoming, USA, subject to applicable law.
